Surprise: Sony faces class action lawsuit on PlayStation Network breach

Sony hasn’t yet recovered from the PlayStation Network outage, but it has already been hit with a class-action lawsuit filed on behalf of an angry user. The suit comes a day after Sony admitted that personal information, including credit card data, had been compromised when hackers broke into its online entertainment service.

The PlayStation Network has more than 77 million registered users, and the data breach is one of the worst in hacking history. Sony said an external attack compromised user information, including names, addresses, birthdays, login passwords, and possibly credit card information.

“We brought this lawsuit on behalf of consumers to learn the full extent of Sony PlayStation Network data security practices and the data loss and to seek a remedy for consumers. We are hopeful that Sony will take this opportunity to learn from the network vulnerabilities, provide a remedy to consumers who entrusted their sensitive data to Sony, and lead the way in data security best practices going forward,” said Ira P. Rothken an attorney who filed the class action complaint.

“Sony’s breach of its customers’ trust is staggering. Sony promised its customers that their information would be kept private. One would think that a large multinational corporation like Sony has strong protective measures in place to prevent the unauthorized disclosure of personal information, including credit card information. Apparently, Sony doesn’t,” said J.R. Parker, co-counsel in the case.

The suit was filed in U.S. district court in San Francisco on behalf of user Kristopher Johns. It alleges breach of warranty, negligent data security, violation of consumer rights to privacy and other charges. For sure, you can now add legal costs to the estimated damages that have resulted from the security breach.

The suite seeks monetary compensation for the data loss and loss of access to the network, credit monitoring costs, and other relief.

Sony hasn’t yet commented on the lawsuit.

    I don't believe for 1 second the law firms are acting on behalf the consumers. They are just a bunch of greedy little b****** that want to buy gold toilets to take a dump in. They are only going to cause more harm to Sony than good. I just want a TIMEFRAME from Sony stating a date they expect the PSN to be back up. Sony needs to be a little more transparent with its customers from here on out, as it should have been from the very beginning. I'm just one of the 70 million pissed off Sony customers.

    No need for a lawsuit yet. How about the idea that sony hasn't lost any information but has a larger plan to come back with a revamped Sony network. This will be great all u have to do to join is pay just like xbox. Do the math even at 1$ a month thats a huge amount of money.. Now if that is true everyone should sue and stop buying sony products which i have always swore by.

    I feel it is too early for any such lawsuit. Only if someone’s information has been used in a manner that is viewed be harmful should there be one. I'm not saying this only because they were hacked, anyone is at risk of being hacked and having their identity stolen, I say this due to the manner in which Sony handled the situation. After knowing there was a breach they waited about four to five days to inform their customers of the potential threat to their personal information.

    people are so greedy and so quick to sue over dumb a@# stuff wanting somthing free my family and i struggle at times but i took the risk by by joining playstation network so i feel its partly on me cant wait to get back online im sure they will have it working alot better this time around i just hope that cards havent ben stolen >>>> please hurry my kids are driving me crazy

Fucking retart, you dont have to use your credit card to buy stuff offline you can buy points and use that! Its peoples own faults for giving it to sony!     @Miranda -Remember the scope of this – 77 million people's private information, including credit card information – which was assured that it was kept private – was compromised, and for 7-10 days they kept making excuses as to why their servers were down (mostly giving the excuse that they were down for simple maintenance). It's not just because people “can't play their games”, but that consumers were lied to about super-sensitive information being whisked out from under their noses while Sony told them nothing for so long.

    Sony is a Multi-Billion dollar company and we are just poor schmucks..they were negligent by not coming clean right away..THEY KNEW what was going on..and kept us in the dark…I dont know about you but i have a family. If these thieves get a hold of my info and try to do something with it..causing me and my family anguish and aggravation, believe im joining this lawsuit cause its BULLSHIT that these SONY people can be so irresponsible with our information..OFF WITH THEIR HEADS!!

    Who do I contact to get on board with this? I want to sue Sony too because they lied for over a week allowing the hackers plenty of time to do whatever with the info. Does it matter that the credit card I had on file with them was already canceled? I still was put in risk. My trophy collection better still be there too!

    and i do agree if someones card or info gets stolen then psn should take care of it,. just dont see the need in jumping the gun >>> i would definatly join in too but i feel no need unless it happens , i cancelled my card i used on psn and changed passwords to everything i could except psn. nothing i can do now but wait and hope . i take this chance every time i buy online so im now hoping for the best its just a shame that we are land of the free and we have people that want to hack and take forr free from hard working people like us > i truly wish you and everyone else involved that no one get thier identity stolen it would be bad and i would hope sony takes care of all or there will be a huge mess because u know they will be lawyered to the gills

What about the hacker? (This was a question for the government) There is countless of stories about hacker in emails, websites, and spam mail that get delivered to the house seeking to get ppl information but the only thing that was done about anything was ppl getting hit for downloading from naspter and kazza. Here a hint from the government, STEP IN AND DO SOMETHING ABOUT THE HACKERS, PROSECUTE TO THE FULLEST!!!!! Ppl saying he was right to try to jailbreak the system he paid for the system with his hard earn cash he can do what he want it's his, but guess what dipshit, you paid for a flat screen tv are you jailbreaking the cable company? If you are guess what you're stealing cable jackass. If you jailbreak your droid phone on verizon network your insurance is hearby discontinued, meaning if something happens to a phone you paid for and it yours, you gonna pay full price and the price of a new insurance contract. Blame the Sony network and sue them but also do something for those that are, about, or getting ready to hack into someone else network or home computer device. ADDRESS THE WHOLE HACKERS AND HACKING PROGRAMS OUT THERE!!!!

    I agree. It is not about the video game, it is about personal info that was stolen after Sony made everybody “think” that THAT information is secure, well, VOILA! it's not! They should be sued! All 77M users should support this lawsuit.

    I use my PSN/PS3 to access my NETFLIX account and watch movies. For a month now, I haven't been able to do anything with my PS3. I received a message that an email has been sent with instructions for changing my password. I waited over 24 hours for the email and once I tied to log on to change my PSN password the freakin site was under maintenance again. Now I have to wait another month for SONY to get its act together.  SONY should be ashamed; even smaller companies encrypt their data. What is wrong with SONY??? I would settle for  a 19-20 inch LCD or Platinum monitor for my computer. It would cost much less than one of those  class action attorneys.”It appears there is nothing common in commonsense”
