<p>Dish Network Co-founder and Chairman Charlie Ergen opened up about his company&#8217;s current legal troubles involving its Hopper DVR during a keynote interview at the <a href="http://allthingsd.com/conferences/dive-into-media/about/" target="_blank" target="_blank">D: Dive into Media</a> conference tonight.</p>
<p>Dish is locked up in <a href="http://venturebeat.com/2012/05/25/dish-hopper-dvr-lawsuit/" target="_blank">legal battles</a> with media companies because of a feature it currently offers to customers that have one of its Hopper DVR boxes, which conveniently skip (or &#8220;AutoHop&#8221;) over the annoying commercial breaks between TV shows that have been recorded using the device. Media companies were even more enraged by Dish&#8217;s efforts to improve upon the technology with its latest true &#8220;TV Anywhere&#8221; initiative, featuring the upgraded the <a href="http://venturebeat.com/2013/01/08/dish-hopper-with-sling/" target="_blank">Hopper DVR with Sling</a> box.</p>
<p>And while the AutoHop feature is more of a formality (most people fast forward through the commercial breaks anyways), News Corp., Comcast, and CBS all claim that the practice is illegal. Fortunately for consumers, Dish sees the conflict as a sign that its doing something right.</p>
<p>&#8220;It always starts with litigation,&#8221; Ergen said in reference to TV&#8217;s track record for bringing innovative technology to the forefront. He likened Dish&#8217;s situation to Hollywood&#8217;s early legal battles with VCR, which turned out to be a billion dollar source of revenue. Ergen even as far as to call Barry Diller&#8217;s new TV anywhere startup Aereo as a &#8220;genius&#8221; idea, while pointing to the service&#8217;s own legal troubles.</p>
<p>&#8220;I don&#8217;t hate ads&#8230; but I don&#8217;t want to put my head in the sand and pretend to watch (current commercials) that aren&#8217;t relevant,&#8221; Ergen said.</p>
<p>Ergen, who has a reputation for making bold statements, said the Hopper was a result of the current model of advertising&#8217;s failure to keep up with modern-day consumer viewing habits. The Hopper box, he said, actually was designed to provide ad targeting to customers while providing for a shorter commercial break between programs and higher revenues to media companies.</p>
<p>Higher revenues and airing fewer commercials wasn&#8217;t something that the media companies were interested in, he said.</p>
<p>Overall, Ergen compared his company to Indiana Jones movies, saying they&#8217;re always getting into trouble, finding themselves in compromising situations, and eventually having everything work out in the end.</p>
<p>Unfortunately, we&#8217;ve yet to see if the courts agree with Dish and its AutoHopping DVR boxes. Should Dish lose its legal battles, media companies could gain the right to outlaw any DVR maker from allowing customer to press the fast forward button during a commercial &#8212; a move that would ensure that the current state of TV advertising stay useless and irrelevant for years to come.</p>

<p>Satellite television provider Dish Network unveiled its plans today to let subscribers start using the Dish TV service beyond the boundaries of their home.</p>
<p>Dish&#8217;s plan addresses one of the biggest complains people have about the often expensive traditional TV subscriptions: you can&#8217;t use it if you leave home. This is contrary to many of the much less costly services like Netflix, Hulu Plus, and Amazon Prime, which allow its respective subscribers to access the entire streaming video services from a variety of mobile devices, smart TVs, and set-top boxes.</p>
<p>At last year&#8217;s CES event, the company tackled a different major complain about traditional pay TV subscription by allowing customers to skip over long-winded commercial breaks on all recorded programs via the <a href="http://venturebeat.com/2012/05/25/dish-hopper-dvr-lawsuit/" target="_blank">Hopper feature </a>on its DVR TV boxes. This year, the company is improving the Hopper box by <a href="http://about.dish.com/press-release/products-and-services/dishs-new-hopper-sling-delivers-unparalleled-choice-and-control-" target="_blank" target="_blank">partnering with Sling Media</a>, a company that produces its own line of devices enabling consumers to live stream their cable TV service when away from home.</p>
<p>Much like the <a href="http://venturebeat.com/2012/10/10/new-slingboxes-add-1080p-video-hdmi-airplay-like-sharing/" target="_blank">Slingbox 500,</a> the Hopper with Sling will let Dish subscribers stream both live television channels and watch saved shows on their DVR. (Right now you can access the &#8220;TV Anywhere&#8221; feature via iOS devices and <a href="http://www.dishanywhere.com/" target="_blank" target="_blank">through the web</a>, but I&#8217;m assuming support for Android devices will come in the near future.) The box has built-in Wi-Fi, Bluetooth support, a remote control finder, and the fastest processor available from any satellite TV provider box, according to the company. As for storage, the Hopper with Sling contains a two-terabyte hard drive, which equals about 500 hours of HD video or 2,000 hours of standard definition video.</p>
<p>Another cool thing the box does is allow you to <a href="http://about.dish.com/press-release/products-and-services/dishs-new-hopper-transfers-app-delivers-dvr-recordings-ipad-offl" target="_blank" target="_blank">send shows recorded on your DVR to your iPad</a>, which can be downloaded for offline viewing. The feature should come in handy for anyone who travels often, and doesn&#8217;t want the added expense of renting or buying a movie to download beforehand. And while not exactly new among TV service providers, Dish is also launching <a href="http://about.dish.com/press-release/products-and-services/dish-explorer-second-screen-app-enhances-tv-viewing-experience-i" target="_blank" target="_blank">second-screen apps</a> to help people discover new content on their smartphones and tablets.</p>
<h3>Creating a consumer-friendly pay TV service</h3>

<p>The push to make Dish a &#8220;TV anywhere&#8221; experience is part of the company&#8217;s strategy to be the only pay TV service that actually gives customers what they&#8217;re asking for, said Dish CEO and President Joseph Clayton at a press event today. I managed to catch the live stream of Dish&#8217;s presentation, which included several references by Clayton about this being &#8220;the year of the Kangaroo.&#8221;</p>
<p>Other cable providers are starting to come around to the idea that their subscribers want more for their money, but thus far, have been slow to offer anything remotely close to what Dish is doing with the Hopper Sling box. For instance, Time Warner Cable recently announced a new <a href="http://venturebeat.com/2013/01/07/roku-adds-time-warner-cable-channel/" target="_blank">TWC TV app on Roku</a> set-top boxes that essentially brings live TV channels to the streaming web, but doesn&#8217;t offer DVR playback or the ability to watch content anywhere. Even more backwards are cable providers like Comcast, who refuses to allow its customers to use services like HBO Go (except for on <a href="http://venturebeat.com/2012/04/06/xfinity-customers-are-finally-getting-hbo-go-on-the-xbox/" target="_blank">Xbox Live</a>), even after authenticating that they pay for a HBO package as a Comcast subscriber.</p>

<p>When Dish Network <a href="http://venturebeat.com/2012/01/09/dish-network-ces-hopper-joey-testdrive/" target="_blank">debuted its new &#8220;Hopper&#8221; DVR box</a> for subscribers of its satellite television service, the assumption was that it would help grow the viewing audience &#8212; not help people avoid the insanely long commercial breaks between recorded programs.</p>
<p>But the Hopper box actually does just that, <a href="http://www.engadget.com/2012/05/10/dish-network-adds-auto-hop-commercial-skipping-feature-to-its/" target="_blank" target="_blank">Authops</a> over the commercials, which prompted broadcast TV stations Fox NBCUniversal, and CBS to file lawsuits against Dish yesterday.</p>
<p>&#8220;We were given no choice but to file suit against one of our largest distributors, Dish Network, because of their surprising move to market a product with the clear goal of violating copyrights and destroying the fundamental underpinnings of the broadcast television ecosystem,&#8221; Fox said in a statement (<a href="http://venturebeat.files.wordpress.com/2012/05/fox-complaint.pdf" target="_blank" target="_blank">PDF</a>) to Dish. “Their wrongheaded decision requires us to take swift action in order to aggressively defend the future of free, over-the-air television.&#8221;</p>
<p>But it gets better. Dish has also decided to file its own lawsuit to get approval for its DVR commercial-skipping technology. Dish&#8217;s suit also wants the courts to confirm that its DVR Hopper box does create unauthorized copies of broadcaster&#8217;s programing that violates copyrights.</p>
<p>In a statement (<a href="http://venturebeat.files.wordpress.com/2012/05/dishnetwork_complaint.pdf" target="_blank" target="_blank">PDF</a>), Dish Network SVP of Programming David Shull said &#8220;consumers should be able to fairly choose for themselves what they do and do not want to watch. Viewers have been skipping commercials since the advent of the remote control; we are giving them a feature they want and that gives them more control.”</p>
<p>It&#8217;s hard to argue with Shull&#8217;s statement, because that majority of people probably do fast forward through the commercial breaks when given the chance. Commercial interruptions have only gotten longer in the last decade, and with the advent of ad-targeting technology available online, those same commercials seem even more out-of-place since they don&#8217;t know exactly who&#8217;s watching a program.</p>
<p>The main takeaway from all of this? Commercials are too long and don&#8217;t apply to the individual viewer. Rather than to continually force the viewing audience to fast forward, switch the channel, or play on their iPhone during a commercial, maybe broadcasters should just address the real issue &#8212; make commercials more palatable.</p>
