<p>A day after a <a href="http://venturebeat.com/2013/03/04/cell-phone-unlocking-petition-white-house-says-yes/">make-cell-phone-unlocking-legal petition</a> at WhiteHouse.gov received a <em>you go, girl</em> from the Obama administration, senators are pouring out of the bureaucratic woodwork and tripping over each others&#8217; thousand-dollar heels to put a bill together, get it on the floor, and pass it.</p>
<p>It&#8217;s almost as if they think this could be popular, or something.</p>
<p>Senator Amy Klobuchar (D-MN) &#8212; no, I&#8217;m not swearing, she&#8217;s just a Dem from Minnie &#8212; wants to <a href="http://www.theverge.com/2013/3/5/4068602/senator-klobuchar-cell-phone-unlocking-bill" target="_blank">get rid of the ban</a> on unlocking cellphones. Senate Judiciary Committee Chairman Patrick Leahy (D-VT) <a href="http://thehill.com/blogs/hillicon-valley/technology/286373-lawmakers-look-to-legalize-cellphone-unlocking?utm_campaign=HilliconValley" target="_blank">wants to legalize cellphone unlocking</a>, and Reps. Darrell Issa (R-CA) and Jared Polis (D-CO) said they&#8217;d support such a bill. Rep. Jason Chaffetz (R-UT) is <a href="https://twitter.com/jasoninthehouse/status/308761632547409920" target="_blank">already working hard on a bill</a>, saying that &#8220;it is a freedom issue.&#8221;</p>

<p>Saddly, all were beaten to the punch by long-suspected brown-noser and probable former teacher&#8217;s pet Sen. Ron Wyden (D-OR), <a href="http://thehill.com/blogs/hillicon-valley/technology/286373-lawmakers-look-to-legalize-cellphone-unlocking?utm_campaign=HilliconValley" target="_blank">according</a> to Hillicon Valley, with a bill titled the Wireless Device Independence Act. (It&#8217;s like the movie, except the phone blows up, not the White House. But only if the carrier doesn&#8217;t allow unlocking.)</p>
<p>All good fun aside, it&#8217;s wonderful to see our elected representatives doing something for the people. And laughable to see how quickly they jump on a populist measure that most of them probably heard about approximately five minutes ago.</p>
<p>I guess it&#8217;s all in a good cause.</p>

<p>&#8220;I just got off the phone with the White House,&#8221; petition creator <a href="https://twitter.com/sinak" target="_blank">Sina Khanifar</a> told me this morning. &#8220;They&#8217;re in full support &#8230; they&#8217;re going to push through legislation to make the change.&#8221;</p>
<p>The petition is in response to a Librarian of Congress ruling in 2012 to remove unlocking of cellphones from DCMA exceptions, meaning that it would become illegal. Khanifar said &#8212; and 114,322 cosigners agreed &#8212; that this would result in customers being &#8220;forced to pay exorbitant roaming fees to make calls while traveling abroad&#8221; and will reduce consumer choice as well as decreasing resale value of devices.</p>
<p>R. David Edelman of the White House staff has responded, saying that &#8220;the White House agrees with the 114,000-plus of you who believe that consumers should be able to unlock their cellphones without risking criminal or other penalties&#8221; and that &#8220;all consumers deserve that flexibility.&#8221;</p>
<p>Khanifar, as you can imagine, is overjoyed with the response &#8212; and the phone call from the White House &#8212; and is hoping that this will lead to more pro-consumer legislation.</p>
<p>&#8220;I&#8217;m really hoping that this momentum can be used to fix a bunch of things,&#8221; he told me, citing the DMCA itself, jailbreaking of phones, and more. &#8220;I&#8217;d love to fix them all.&#8221;</p>
<p>How long will it take?</p>
<p>Khanifar, while overjoyed with the current result, was realistic about the realities of our political system.</p>
<p>&#8220;God knows,&#8221; he said.</p>

<blockquote><p>Thank you for sharing your views on cell phone unlocking with us <a href="https://petitions.whitehouse.gov/petition/make-unlocking-cell-phones-legal/1g9KhZG7" target="_blank">through your petition</a> on our We the People platform. Last week the White House brought together experts from across government who work on telecommunications, technology, and copyright policy, and we&#8217;re pleased to offer our response.</p>
<p>The White House agrees with the 114,000+ of you who believe that consumers should be able to unlock their cell phones without risking criminal or other penalties. In fact, we believe the same principle should also apply to tablets, which are increasingly similar to smart phones. And if you have paid for your mobile device, and aren&#8217;t bound by a service agreement or other obligation, you should be able to use it on another network. It&#8217;s common sense, crucial for protecting consumer choice, and important for ensuring we continue to have the vibrant, competitive wireless market that delivers innovative products and solid service to meet consumers&#8217; needs.</p>
<p>This is particularly important for secondhand or other mobile devices that you might buy or receive as a gift, and want to activate on the wireless network that meets your needs &#8212; even if it isn&#8217;t the one on which the device was first activated. All consumers deserve that flexibility.</p>
<p>The White House&#8217;s position detailed in this response builds on some critical thinking done by the President&#8217;s chief advisory Agency on these matters: the Department of Commerce&#8217;s National Telecommunications and Information Administration (NTIA). For more context and information on the technical aspects of the issue, you can review <a href="http://www.ntia.doc.gov/files/ntia/publications/ntia_2012_dmca_letter_final.pdf" target="_blank">the NTIA&#8217;s letter to the Library of Congress&#8217; Register of Copyrights (.pdf)</a>, voicing strong support for maintaining the previous exception to the Digital Millennium Copyright Act (DMCA) for cell phone carrier unlocking.</p>
<p>Contrary to the NTIA&#8217;s recommendation, the Librarian of Congress ruled that phones purchased after January of this year would no longer be exempted from the DMCA. The law gives the Librarian the authority to establish or eliminate exceptions &#8212; and we respect that process. But it is also worth noting the <a href="http://www.loc.gov/today/pr/2013/13-041.html" target="_blank">statement the Library of Congress released today</a> on the broader public policy concerns of the issue. Clearly the White House and Library of Congress agree that the DMCA exception process is a rigid and imperfect fit for this telecommunications issue, and we want to ensure this particular challenge for mobile competition is solved.</p>
<p>So where do we go from here?</p>
<p>The Obama Administration would support a range of approaches to addressing this issue, including narrow legislative fixes in the telecommunications space that make it clear: neither criminal law nor technological locks should prevent consumers from switching carriers when they are no longer bound by a service agreement or other obligation.</p>
<p>We also believe the Federal Communications Commission (FCC), with its responsibility for promoting mobile competition and innovation, has an important role to play here. FCC Chairman Genachowski today <a href="http://hraunfoss.fcc.gov/edocs_public/attachmatch/DOC-319250A1.pdf" target="_blank">voiced his concern about mobile phone unlocking (.pdf)</a>, and to complement his efforts, NTIA will be formally engaging with the FCC as it addresses this urgent issue.</p>
<p>Finally, we would encourage mobile providers to consider what steps they as businesses can take to ensure that their customers can fully reap the benefits and features they expect when purchasing their devices.</p>

<p><a href="https://petitions.whitehouse.gov/petition/make-unlocking-cell-phones-legal/1g9KhZG7" target="_blank">A petition opposing</a> last month&#8217;s <a href="http://venturebeat.com/2013/01/25/unlocking-illegal-carriers-end-subsidies/">controversial decision to ban unsanctioned smartphone unlocking</a> has passed the key threshold of 100,000 signatures today, guaranteeing that it will get a response from the White House.</p>
<p>Former Republican Study Committee staffer Derek Khanna, who helped lead the campaign, says he isn&#8217;t surprised the petition made it this far.</p>
<p>&#8220;I think the interest pretty clearly demonstrates that average people want smart tech policies. People recognized that the law invades their property rights, and they&#8217;re not happy with it,&#8221; he told me by phone today.</p>
<p><a href="http://venturebeat.files.wordpress.com/2012/09/t-mobile-unlocked-iphone.jpg" target="_blank"><img class="alignright size-medium wp-image-528407" alt="t-mobile unlocked iphone" src="http://venturebeat.files.wordpress.com/2012/09/t-mobile-unlocked-iphone.jpg?w=300&#038;h=233" width="300" height="233" /></a>High-profile supporters of the bill include Electronic Frontier Foundation founder John Perry Barlow, publishing kingpin Tim O&#8217;Reilly, and Internet granddaddy Vint Cerf.</p>
<p>Khanna says the involvement of these tech luminaries is hugely significant. &#8220;Their interest shows that this a big issue, that this an important issue, and that the law itself is asinine,&#8221; he said.</p>
<p>Khanna says that, though the petition has already passed the biggest threshold, he&#8217;s intent on getting more signatures before Saturday, when the signing window closes. But the petition is just the start of the process, and Khanna and his supporters have a long way to go before the unlocking ban can get overturned.</p>
<p>&#8220;It&#8217;s a long process, but this is a clearly a show of force,&#8221; Khanna said.</p>
<p>As someone who has scribbled my name on more ineffectual petitions than I can count, I&#8217;m both surprised and glad the campaign has gotten this far. Nice job, democracy.</p>

<p>The unlocked smartphone is about to become an endangered species in the U.S.</p>
<p>Starting Sunday, it will be illegal to jailbreak your phone without the permission of your carrier. While this doesn&#8217;t extend to phones like Verizon&#8217;s iPhone 5 &#8212; which ships unlocked &#8212; it does show how laws like the Digital Millennium Copyright Act (DCMA) can be stretched far beyond their original scope.</p>
<p>Every three years the Library of Congress, working with the U.S. Copyright Office, hands out exemptions to the DCMA, which controls how copyright applies to digital content. The latest round of exemptions came last October, when the Library of Congress decided that sanctioned unlocking methods were strong and extensive enough that it didn&#8217;t make much sense to allow for unsanctioned methods.</p>
<p>&#8220;The record clearly demonstrates that there is a wide range of alternatives from which consumers may choose in order to obtain an unlocked wireless phone,&#8221; <a href="https://s3.amazonaws.com/public-inspection.federalregister.gov/2012-26308.pdf" target="_blank">the Library of Congress wrote in its decision</a>.</p>
<p>As a result, unlocking your new smartphone is now a big no-no unless you have the permission of the carrier that you bought it from. Say hello to the dark side of the smartphone subsidy.</p>
<p>For carriers, the measure is a major win because it makes it that much harder for consumers to take their devices (and business) elsewhere. As for consumers &#8230; well, it should be pretty obvious why the move is bad for them.</p>
<p>Tinker-happy companies like iFixit aren&#8217;t crazy about the whole deal. &#8220;The Copyright Office’s decision to outlaw this right of ownership hurts users and further empowers carriers to trap consumers,&#8221; iFixit <a href="http://ifixit.org/4114/say-goodbye-to-legal-unlocking/" target="_blank">wrote on its blog today</a>.</p>
<p>While all of that&#8217;s true, the measure is also proof of something that&#8217;s become increasingly obvious to me in recent months: The smartphone subsidization model is simply a bad deal for consumers. Not only does it lock people into lengthy contracts, but it also results in a grossly asymmetrical balance of power. Consumers just don&#8217;t win, even if they are playing a bit less for their smartphones.</p>
<p>Perhaps the silver lining here is that we&#8217;re finally realizing that.</p>
