When I’m listening to music on my iPhone, I usually take advantage the song ‘shuffle’ function. It’s pretty good, but I end up skipping half the songs. I could make a playlist, but what can I say, I’m lazy. A new application, Instinctiv Shuffle, sounds perfect for what I need.

Instinctiv Shuffle remembers your preferences as you play shuffled songs. It knows what you skip, what you listen to all the way through and alters your shuffled playlist accordingly. Consider it a “smart shuffle,” as Instinctiv chief executive Justin Smithline calls it. (Instinctiv is Instinctiv Shuffle’s parent company.)

This works seamlessly because Instinctiv Shuffle is an application that can access the music on your iPhone or iPod Touch. It then sends this data over the Internet to Instinctiv’s servers where it is analyzed and sent back to your device.

This of course means that for Instinctiv Shuffle to work, you will need to jailbreak your device. (Jailbreaking basically involves opening your device to run applications not created by Apple.) That is easy enough to do for now, and Instic’s site directs you to a place with jailbreaking instructions.

While the initial thought was to create this application for the upcoming App store, Smithline and co-founder Peter Brodsky found Apple’s requirements for officially sanctioned native apps to be too restrictive. While Smithline didn’t elaborate on this, it’s likely that Apple doesn’t want apps to change the iPod functionality on the iPhone or iPod Touch.

As such, Instinctiv Shuffle won’t work on the iPhone 3G until someone (inevitably) jailbreaks it.

Along with the application launch, the Ithaca, New York-based Instinctiv is announcing a first round of funding for $750,000. The round was funded by Cayuga Venture Fund, Rosetech Ventures and a group of angel investors.
