Dali Wireless Inc. files suit against Corning Optical Communications LLC, alleging infringement of US Patent Nos. 10,159,074 and 9,769,766. Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of Corning’s SpiderCloud Enterprise Radio Access Network (“E-RAN”) System

Dali Wireless, Inc. today announced it has filed a lawsuit in the United States District Court for the Western District for North Carolina, Charlotte Division against Corning Optical Communications LLC, for the infringement of U.S. Patent Numbers 10,159,074 and 9,769,766 (case No. 3:19-cv-714). Dali’s patents disclose and claim software defined radio systems that are building blocks for the 4G/5G era in in-building wireless networks. In its complaint, Dali alleges that Corning incorporated technologies covered by Dali’s patents into their SpiderCloud Enterprise Radio Access Network (“E-RAN”) System. Dali has petitioned the Court and seeks injunctive relief and appropriate damages to compensate Dali for Corning’s infringement.
Dali’s recent lawsuit against Corning comes on the heels of two previous lawsuits filed against CommScope Technologies LLC. The first lawsuit, filed in the United States District Court for the Northern District of Texas (case number 3:16-cv-477-M), resulted in a favorable outcome for Dali. The Dallas jury determined that CommScope infringed both of Dali’s patents-in-suit (U.S. Patent Nos. 9,031,521 and 9,531,473) and awarded Dali over $7 million in net damages. Dali had also asserted U.S. Patent No. 8,149,950 in this litigation, but that claim was dismissed when Texas Instruments-CommScope’s supplier on the relevant chip-entered into an agreement with Dali to license the ‘950 patent.
In May 2019, Dali filed a second suit against CommScope Technologies LLC and CommScope Holdings Company Inc., in the United States District Court for the District of Delaware alleging infringement of U.S. Patents 10,045,314, 10,080,178, 9,847,816, and 8,682,338. In that case Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of CommScope’s OneCell and ION-E products.
